Industrial Accidents

Did you know that every year, 4.7 workers per hundred receive serious on the job injuries. The US Dept of Labor keeps these statistics. The US House of Representatives Committee on Education and Labor would like to change this. But it takes time to pass legislation. Meanwhile workers are being unnecessarily killed and injured.

The civil justice system in our country provides for injured and killed workers and their families to receive just compensation. But sometimes our court system does even better than that. In my 30 years experience as a personal injury lawyer I have seen that when companies are hit with big jury verdicts they sometimes fix the problem that caused the injury or death to avoid causing similar injuries and death in the future. Needless to say this is a major positive side effect of litigation and an important benefit for all workers. So the next time you hear big business bureaucrats shouting for tort reform, think about the lives our civil justice system saves.

For more information on this subject matter, please refer to our section on Worksite Injuries and Workers Compensation.

Originally posted at InjuryBoard by Ed Van Dorn

Vermont Delays New Workers Comp Rehab Rules Temporarily

Vermont Labor Department has delayed plans to change the way injured workers are evaluated for workers' comp claims.

Stephen Monahan, director of the Workers Compensation and Safety Division, on Wednesday asked the Legislature's Administrative Rules Committee to delay the consideration of new rules which were on the panel's agenda that afternoon. The section of the new rules that need to be clarified further deal with the way the state assesses the injuries that workers suffer on the job, Monahan said.

"Unfortunately, I have just learned that the Division of Vocational Rehabilitation needs to obtain legislative authority to bill for these services, and since such authority cannot be sought and obtained until the new Legislature is in session, it is necessary for the department to develop an interim proposal for these rules,'' said a memo Monahan wrote to committee chairman Sen. Mark McDonald, D-Orange, and Vice Chairman Rep. Clinton Martin, D-Springfield.

Monahan said his office would have a new set of proposed rules prepared for the committee to consider at its next meeting, scheduled for Jan. 11. "We expect to be ready,'' Monahan said.

Originally posted at InjuryBoard by Christina Cole

Who Is Bashing Trial Lawyers

I'm the first to admit that I sometimes laugh at lawyer jokes. Like the one about the attorney who fell out of the ocean liner only to be thrown back aboard by sharks out of "professional courtesy."

But I think that the lawyer bashing that has taken place over the past several years has been driven by something more than humor. Many in the business and insurance communities have an agenda that includes continually demonizing lawyers. The companies understand that if the public sees victim's lawyers as greedy and corrupt, they (the companies) have a leg up when they have to square off against one of these lawyers in the courtroom. The real losers in all this are the accident victims in personal injury cases who have the cards stacked against them from the outset. So the next time you hear trial lawyers being run down ask yourself who has an agenda to do this. Please watch the attached video for more information:

http://www.youtube.com/watch?v=h85j1vNxd8A

Originally posted at InjuryBoard by Rob Curtiss
