Botulism and Product Liability

Recently there has been a recall of 10 seperate items manufactured by Castleberry Foods that may contain botulism.

Botulism is a rare but serious paralytic illness caused by a nerve toxin that is produced by the bacterium Clostridium botulinum. There are three main kinds of botulism. Foodborne botulism is caused by eating foods that contain the botulism toxin

Since the food products have been distributed in New England it is wise not to eat this type of food product until the problem is resolved.

Makers of defectively manufactured products that cause injury or death may be liable. The law provides that if a manufacturer makes an unreasonably dangerous product then they may be liable for harm caused by that product. By definition a food product that contains botulism is unreasonably dangerous.

The best thing a consumer can do is to avoid these dangerous food products, click here on dangerous food products for a list of what to avoid. However if you or a loved one is seriously injured or killed by the contaminated food there may be legal help to pay for medical bills and other losses.
