Steroids are a Danger to the Players as Well as to the Game

With the long awaited release of the Mitchell Report, many baseball fans are weighing in on the way illegal steroid use has changed our national game. One intense area of focus is whether record setting steroid users (most homeruns, etc.) should be considered in a separate category from ballplayers who set records without resorting to performance enhancers.

One issue that seems to get passed over in the debate is just how dangerous steroids are. Anabolic steroids can lead to premature heart attacks, liver tumors, kidney failure, and psychiatric problems. Most of us want to clean up our national game, and we should remember that one of the primary reasons for doing this is to protect the lives and health of our young athletes who play the game.

As a law firm dedicated to helping injury victims we are committed to improving public safety. So for all the right reasons lets get steroids out of baseball. For more on this issue go to: http://sports.espn.go.com/mlb/news/story?id=3060689

For more information on this subject, see our section on Defective and Dangerous Products.

Originally posted at InjuryBoard by Rob Curtiss

An Accident Can Spoil Your Holidays

Driving during the Christmas season can be rough. Roads are congested with shoppers. Motorists heading home after holiday parties may have had an eggnog or two. The season itself seems to add to some people's stress level.

That is why it is important to drive extra cautiously at Christmas time. Having represented several people who were seriously injured in Christmas time car collisions, I can endorse this wholeheartedly. So be courteous and calm behind the wheel, don't let the pressure of the season get to you. After all, the last thing anybody needs at Christmas is an accident. For more on driving during the holiday season see: http://www.maimonidesmed.org/body.cfm?id=1534
http://alcoholism.about.com/od/holiday/a/aa991208.htm

For more information on this subject, please refer to the section on Car and Motorcycle Accidents.

Originally posted at InjuryBoard by Rob Curtiss

Wal-Mart Removed Toxic Doggie Treats From Shelves

The Associated Press reported that amidst venting of complaints from consumers about dog treats that made their pets ill, the retail chain has tidily pulled the doggie treats from shelves without announcing a formal recall.

Wal Mart removed Chicken Jerky Strips and Chicken Jerky, both imports of China, from shelves, on July 26, according to reports. As a further safeguard to the public, Wal Mart initiated a computerized block on all sales of these items at all in-store cash registers. This was undertaken to allow the giant retailer some time to conduct testing on these products to determine the root of the problem.

This pet strips 'quiet' recall follows the massive Menu foods debacle in which there were reported at least 14 animal deaths due to kidney failure as a result of consuming pet food contaminated with melamine.

For more information on this subject matter, please refer to the section on Defective and Dangerous Products.

Originally posted at InjuryBoard by Courtney Mills

Avandia and Personal Injury

Yet another drug maker has come under attack for not disclosing that one of its drugs may cause serious heart problems. This time its the drug Avandia and the maker is GlaxoSmithKline.

Today's New York Times reports about this dangerous drug

A federal drug safety official recommended during an advisory committee hearing today that Avandia, a controversial diabetes medicine made by GlaxoSmithKline, be withdrawn from the market because it increases heart risks.

If you or a loved one has suffered heart damage through the use of the drug Avandia you may have a defective product claim against the drug's maker GlaxoSmithKline. Under Vermont product liability law a manufacturer of an unreasonalby dangerous drug may have a product liability claim against its maker. Pharmaceutical claims can be complicated so if you are thinking of legal action you should consult an attorney with experience in product liability law. I have been handling product liability cases for 30 years. My firm offers free consultations.

For more information on this subject, please refer to our section on Drugs, Medical Devices, and Implants.

Originally posted at InjuryBoard by Ed Van Dorn

Product Liability Lawsuit Overturned

A Washington appeals court has ruled a manufacturer did indeed bare the responsibility of warning a plaintiff of potential asbestos exposure even when the manufacturer's water evaporator used on Navy ships did not contain asbestos.

The ruling stems from a product liability lawsuit brought upon by a man that was diagnosed with lung cancer and asbestos-related disease back in 2000.

Simonetta worked as a Navy machinist mate during the late 1950s, court records show. After he sued, a trial court granted the manufacturer summary judgment, finding that it did not have a duty to warn because the asbestos exposure did not stem from the evaporator itself, nor did its evaporator cause the harm.

But the Washington Court of Appeals, Division 1 overturned that verdict. It found instead that Viad knew that asbestos was necessarily used to insulate its product and posed a health risk to anyone servicing the evaporator.

In a similar ruling Monday Bratten vs. Buffalo Pumps Inc, the same appeals court held four manufacturers responsible to warn the naval shipyard pipe fitter whose job included removing asbestos parts or insulation on a regular basis around the pipes and machinery that they manufactured.

This decision overturned a trial court's summary judgment that the manufacturers did not have a responsibility to notify. Both cases were remanded for further proceedings by the appeals court.

Originally posted at InjuryBoard by Christina Cole
